The Machinists Union received 40 of the 43 valid votes cast in Internet and telephone voting.
“Delta Air Lines interfered in the election process in violation of the Railway Labor Act and IAM attorneys are reviewing what steps to take next,” the union said in a statement. “This matter is not closed.”
Unlike most elections in the United States, a simple majority of votes is not sufficient to prevail in elections for the nation\'s air and rail employees. Fifty percent plus one of the employees in the bargaining unit must participate for the election to be valid. In addition, the National Mediation Board counts people who don’t vote as voting against union representation.
The board currently is reviewing its election rules.
