In a decision that could improve both rail worker safety and community safety, U.S. District Court Judge Michael Davis ruled for the United Transportation Union.
The judge, according to the St. Paul Union Advocate, said states, cities and towns have the power to regulate what is "an essentially local" safety hazard. The UTU, with help from the Minnesota attorney general’s office, sued the Duluth, Winnipeg and Pacific Railway over the rail firm\'s maximum train speed in the small town of Orr, Minn., of 60 mph.
The town, the union and the state wanted that speed cut in half since the grade crossing in Orr "had identifiable design problems." Judge Davis agreed, but the rail line, a subsidiary of Canadian National Railways, has appealed the case to the 8th U.S. Circuit Court of Appeals in St. Louis.
